Guidelines for assisting clients with configuring waivers
Fareharbor employees, including Account Management, Support, and Sales, are equipped to assist clients with the technical aspects of setting up waivers. However, it is crucial that we do not overstep into legal advisory roles.
What We Can Do
Important notes:
- We should only support clients on the FareHarbor waiver product upon the client’s clear and specific instruction. It should be crystal clear that FareHarbor merely executes/supports. The client is fully responsible for how they set up waivers and what content they want to use.
- Before supporting clients on the FareHarbor waiver product, the client’s instruction must be on paper. If the client asks FareHarbor to take a certain action in an email, that is covered. If the relevant action is not in an email/message, please send a confirmation email/message to the client with the actions that you’ll take based on the client’s instruction.
- Assist clients in configuring the waiver settings, such as name, instructions, text for the marketing checkbox, assigning waivers to specific items, choosing to use a handwritten signature or an acceptance checkbox for a waiver, etc.
- Copy and paste the content of the waiver from a third-party tool (Smarwaiver, Google docs, etc.) into FH Dashboard.
- Change the content of the waiver.
- Execute configurations as directed by the client, ensuring that all actions are documented (could be emails, phone calls or short follow up emails from in-person visits).
What We Cannot Do
- Make decisions about or provide advice on the content of the waiver, including its legal adequacy or compliance.
- Modify any waiver content unless specifically instructed by the client.
- Interpret the legal implications of the waiver content.
